GPSR for Etsy sellers: handmade is not exempt, the Responsible Person field, and what changes for makers shipping into the EU

Etsy is a marketplace under GPSR Article 22, and 'handmade' carries no exemption from the General Product Safety Regulation. Since 13 December 2024, every Etsy listing shipped into the EU 27 must carry manufacturer, Responsible Person, and warnings — and Etsy delists listings missing them. Here is what an Etsy shop actually needs to do.

Etsy's positioning around handmade and small-batch sometimes leads makers to assume that the EU's product-safety perimeter does not apply to them. It does. GPSR does not exempt handmade, artisan, or small-volume production. Since 13 December 2024, every Etsy listing shipped into the EU 27 must carry the same Article 19 information as a listing on Amazon — manufacturer, EU Responsible Person, warnings, sufficient product identification.

This guide is the practical, shop-level version of our GPSR overview for Etsy sellers — particularly UK, US and other non-EU makers shipping into the EU. It covers what Etsy actually enforces, what the Responsible Person field expects, and the categories that carry the most exposure.

What Etsy enforces

Etsy implements GPSR Article 22 through three mechanisms:

1. The Responsible Person field at shop level. A single Responsible Person record applies to all listings in the shop. The shop owner enters the EU-established entity's name, address, and contact. Etsy renders it on the public listing in a Product Safety Information section.

2. The EU shipping filter. Listings without a valid Responsible Person are hidden from buyers in the EU 27 — the listing remains live for buyers outside the EU, but is filtered out of search and not purchasable from EU IPs.

3. The shop-level compliance warning. Etsy surfaces an Account Health style banner when GPSR fields are missing, with a link to the Shop Manager > Settings > Production and Compliance section.

There is no per-listing override — the Responsible Person designation is per shop, so if you sell into the EU 27 from your Etsy shop, every listing in the shop needs it.

"Handmade" carries no GPSR exemption

GPSR Article 2 (scope) covers all non-food consumer products placed on the EU market by an economic operator in the course of a commercial activity. There is:

  • No exemption for handmade — a hand-poured candle is in scope on the same terms as a mass-produced one.
  • No exemption for small batch — a 50-unit production run carries the same Article 9 and Article 19 obligations.
  • No exemption for low revenue — the Regulation does not gate by turnover.

The Toy Safety Directive (2009/48/EC) similarly applies to handmade toys. The REACH restrictions on jewellery (lead, cadmium, nickel) apply to handmade jewellery. The Cosmetics Regulation (1223/2009) applies to handmade soap, balm, and skincare.

The high-risk Etsy categories

Categories where Etsy makers carry the most regulatory exposure, in rough order:

Children's items, toys, and items for under-3s. Toy Safety Directive on top of GPSR. Specific chemical restrictions, choking-hazard warnings, age labelling, and CE marking obligations. Wooden toys, knitted toys, fabric toys, dolls — all in scope.

Jewellery and accessories with metal contact. REACH restrictions on lead, cadmium, and nickel release. Hand-made jewellery is the most-flagged category in Safety Gate (RAPEX) alerts in the EU.

Candles, wax melts, soap, balm, bath products. CLP (Classification, Labelling and Packaging) Regulation on labelling of hazardous substances. Cosmetics Regulation for anything applied to skin — registration in the CPNP (Cosmetic Product Notification Portal) is mandatory before placing on the EU market, with a Responsible Person under the Cosmetics Regulation (separate concept from the GPSR EU RP, though often the same entity).

Electronics, lighting, electrical items. Low Voltage Directive, EMC Directive, RoHS, WEEE registration. Even small electrical accessories trigger multiple regimes.

Skincare, balms, perfumes. Cosmetics Regulation — high enforcement priority, frequent Safety Gate alerts.

If you sell in any of these categories on Etsy and ship into the EU, the GPSR Responsible Person field is the floor, not the ceiling.

Designating an EU Responsible Person as a UK / US Etsy seller

The same EU RP role described in our EU Responsible Person guide applies to Etsy sellers. The role is:

  • An EU-established natural or legal person.
  • Designated by written mandate.
  • Reachable in the official language(s) of the relevant Member State(s).
  • Holding the technical documentation for the product.
  • Capable of receiving and forwarding authority requests within statutory timelines.

For a small Etsy maker, the cost typically lands in the £20–£100/month range for a single-product line, scaling with category complexity and the number of SKUs covered. The most common gap: paying for a £5/month address-only service that has not actually signed the mandate or accepted the document-holding duty. Article 22 verification on Etsy passes the address-only service; an actual authority enquiry does not.

EPR — separate from GPSR, also enforced by Etsy

Etsy also enforces EPR registration in several Member States:

  • Germany (LUCID) — packaging EPR via Stiftung Zentrale Stelle.
  • France (Unique Identifiers per stream) — packaging, plus electronics or textiles if applicable.

For Etsy sellers at low volume, Germany typically has a small-quantity threshold below which simplified registration applies; France has been tightening enforcement on cross-border sellers in 2025–2026. (See our EPR by country guide.)

EmpCo — green claims on Etsy listings

Etsy is rich in green-claim language — "eco-friendly," "sustainable," "zero waste," "natural," "non-toxic." EmpCo (Empowering Consumers Directive 2024/825), enforceable from 27 September 2026, bans these terms when not specifically substantiated.

For an Etsy maker, the EmpCo audit is unusually achievable: open the listing description and remove generic green claims unless you have dated, specific, demonstrable substantiation. "Made from recycled materials" with the supplier-side recycled-content certificate stored is defensible; "eco-friendly" without further specification is in the EmpCo banned-practice list. The Etsy seller checklist

  1. Designate an EU Responsible Person with a written mandate, if you are non-EU.
  2. Populate the Responsible Person field in Shop Manager > Settings > Production and Compliance.
  3. Add the Article 19 information to your listing descriptions — manufacturer details, warnings, sufficient product identification — even where Etsy renders the RP block separately.
  4. Address the category-specific regimes — Toy Safety, REACH, CLP, Cosmetics, EMC/LVD/RoHS — as applicable to what you sell.
  5. Register for EPR in your top destination Member State(s).
  6. Audit your descriptions for EmpCo-banned green claims and either substantiate or rephrase.
  7. Hold the technical documentation — bill of materials, supplier details, substance declarations, test reports — even if it is a one-page file for a simple product.

A handmade Etsy shop that does this work in 2026 is operating defensibly. A shop that ignores GPSR because it is "just handmade" is a Safety Gate alert and a delisting away from losing its EU market overnight.

Frequently asked questions

Is Etsy an online marketplace under GPSR Article 22?+

Yes. Etsy qualifies as an online marketplace under GPSR Article 22 and is required to verify that listings carry the Article 19 information (manufacturer, EU Responsible Person, warnings, sufficient product identification) and to act on non-compliance — including delisting listings shipping into the EU 27 that do not carry the required fields. Etsy has implemented this as a Responsible Person field in shop settings, applied at the listing level.

Does 'handmade' or 'small batch' exempt me from GPSR?+

No. GPSR (Regulation 2023/988) does not exempt handmade, artisan, or small-volume producers. The Regulation applies to any economic operator placing a covered consumer product on the EU market, regardless of production scale. There is no SME exemption for the core safety obligations or for the Article 19 listing duty.

Do I need an EU Responsible Person if I am a UK or US Etsy seller shipping into the EU?+

Yes. The UK is non-EU under GPSR; US and other non-EU sellers obviously are. If you ship into the EU 27 from outside it, you need an EU-established Responsible Person designated under GPSR Article 16. Etsy's Responsible Person field expects an EU-established entity for shops shipping into the EU.

What if I make jewellery, candles, soap, or children's items?+

These are exactly the high-risk categories under GPSR enforcement. Jewellery is in scope of the REACH restrictions on lead, cadmium, and nickel; candles and soap touch CLP labelling and cosmetics regulation; children's items are in scope of the Toy Safety Directive on top of GPSR. The Etsy Responsible Person field is the GPSR baseline; category-specific obligations still attach on top.

Can Etsy itself act as my EU Responsible Person?+

No. Etsy is the marketplace operator under Article 22, not the manufacturer or the EU RP. Etsy's role is to verify your Responsible Person designation, not to be it. You need to designate an EU-established entity yourself.

What happens to an Etsy listing without a Responsible Person?+

Etsy hides the listing from buyers in the EU 27 — the listing remains live for buyers outside the EU, but is filtered out of EU search and not purchasable from EU IPs. The shop owner sees a compliance warning in the shop dashboard. Populating the Responsible Person field at shop level applies to all listings in the shop simultaneously.
