French EPR representative requirement: what changed in 2026

France requires non-established EPR producers to appoint a French mandataire. Understand written mandates, platform coverage and practical next steps.

France has introduced a national representative requirement for producers outside France. Article 5 I(2) of Law n° 2026-602 of 8 July 2026 creates Article L. 541-10-9-1 of the Environmental Code. Although the law concerns the textile industry's environmental impact, this clause refers to the general EPR framework, not just textiles.

What changed on 10 July 2026

A person not established in France who is subject to extended producer responsibility under Articles L. 541-10 or L. 541-10-9 must designate, by written mandate, a natural or legal person established in France. The mandataire is subrogated to the EPR obligations covered by the mandate it accepts.

For the separate EU packaging framework and phased design obligations, read our PPWR packaging guide. Product safety representation is a different role: see the EU Responsible Person guide.

The law was published on 9 July 2026. The representative clause follows ordinary commencement on 10 July 2026. Article 5 II delays a different part of Article 5 — the textile provisions in I(3)(c) — until 1 September 2026. That postponement does not cover the representative clause in I(2).

Who is affected

The relevant question is whether the responsible producer is established in France and falls within a French EPR stream. This can include a US or UK seller supplying French customers, an EU business established in Germany or the Netherlands, or a marketplace seller without a French establishment.

A French entity may itself be the responsible producer. Having a French subsidiary does not automatically settle the obligations of a separate foreign seller: identify which legal person places the covered products on the market. Product scope and the national producer definition still matter; simply shipping to France does not establish every EPR obligation.

Which streams are covered

The provision is not limited to packaging or fast fashion. It refers to the general EPR framework. Relevant French streams include household packaging, textiles and footwear, electrical and electronic equipment, batteries, furniture, toys, sports and leisure goods, and DIY and garden products.

Build a product-by-stream map rather than relying on an approximate total number of French filières. A packaged electronic product containing a battery can involve several separate schemes. Each applicable stream needs its own registration and reporting review.

Mandataire is not the same as facilitator

A mandataire accepts a written mandate and carries the EPR obligations it covers. A facilitator helps with administration, software or coordination. A software subscription, consulting engagement or logistics contract alone is not a representative appointment.

Check the legal entity's French establishment, the scope of its accepted mandate, and the relevant ADEME/SYDEREP and éco-organisme procedures. Keep the mandate and registration records together. Regonance is a software facilitator, not a mandataire, and does not provide the legal appointment required by this provision.

The platform provision is not automatic coverage

Article L. 541-10-9-1 treats appointment as satisfied for products for which a person covered by Article L. 541-10-9, established in France, ensures compliance with EPR obligations.

Do not assume that a marketplace's French domain, fulfilment service, or pay-on-behalf programme meets these conditions. Ask for written confirmation identifying the responsible legal person, covered products, streams and sales. Coverage for particular marketplace products does not establish coverage for your own website or other channels.

Keep French EPR and PPWR separate

The French mandate rule is national and refers to the general EPR framework. PPWR, Regulation (EU) 2025/40, Article 45(3), addresses packaging EPR. It requires producers defined in Article 3(1)(15)(c) and (d), including cross-border direct-to-end-user sellers, to appoint a representative by written mandate in each relevant Member State other than their state of establishment.

PPWR's general application date is 12 August 2026. Parliament adopted negotiating amendments to a proposed suspension on 20 October 2026; this is not an enacted suspension. Check the current official text before acting. The French mandate provision applies independently across the relevant French EPR streams.

Registration and IDU penalties

The French environment ministry explains that, under Article L. 541-9-5, an additional administrative fine can reach €30,000 for failing to register with SYDEREP, providing incomplete or incorrect register information, or failing to display the unique identifier where required. This is a ceiling, not an automatic fine, and is distinct from the new mandataire appointment rule. Do not assume a fixed €30,000 charge per stream without reviewing the precise offence and enforcement decision.

What to do now

  1. Identify the responsible producer and whether it is established in France.
  2. Map the French EPR streams applicable to your products and packaging.
  3. Where required, appoint a mandataire established in France by written mandate covering the relevant obligations.
  4. Confirm registration, reporting and payment arrangements with the relevant éco-organismes and ADEME/SYDEREP procedures.
  5. Obtain and retain the applicable unique identifiers (IDUs) and check the details against each stream.
  6. Obtain documentary confirmation of any platform coverage, including products and sales channels. Review uncovered sales separately.

Sources and scope

The law's ultra-fast-fashion measures are separate from the general representative provision. Do not transfer textile-specific penalties or commencement dates to all EPR streams. National enforcement and any missing-IDU penalty must be assessed under their own legal basis.
