EU PPWR Packaging Regulation: Seller Compliance Guide 2026

Packaging EPR, representation, materials and phased design requirements, with the correct empty-space and labelling date triggers.

BY THE REGONANCE EDITORIAL TEAM

The Packaging and Packaging Waste Regulation (PPWR), Regulation (EU) 2025/40, replaces the EU Packaging Directive with directly applicable rules. It entered into force on 11 February 2025 and its general application began on 12 August 2026. It covers packaging across materials and sectors, from product boxes and transport pallets to e-commerce mailers. A seller of packaged products must assess packaging duties alongside, not instead of, product-safety requirements.

The important distinction is between general application and the start of each specific requirement. It is not accurate to say that all design, recycled-content and digital-label rules became mandatory in August 2026. Several requirements start later or depend on implementing measures. Our Quick Compliance Scan provides a first view of the regulation profile; this guide separates present preparation from future thresholds.

Who needs to comply

PPWR allocates duties to packaging manufacturers, suppliers, importers, distributors, producers and other economic operators. Those labels are legal roles, not simply job titles. The manufacturer responsible for packaging conformity may not be the same business as the producer responsible for packaging EPR in a destination country. An online retailer can have duties for both the packaging around its products and the shipping packaging it adds.

There is no blanket small-business exemption from the regulation. However, particular reuse provisions contain scope limits and exemptions, so “every small seller must meet every target” would also be wrong. Document material, packaging type, use, annual quantities, destinations and supply arrangements before deciding which provisions apply. B2B packaging is within scope even when no consumer sees the package.

For cross-border sellers, fulfilment does not settle producer status by itself. Identify who first makes the packaging or packaged product available in each Member State under Article 3’s producer definition. Contracts, ownership and the actual supply flow matter. Do not assume an Amazon fulfilment arrangement gives a universal exemption from EPR registration, reporting or representation.

Requirements applying now and phased design duties

General application brings the economic-operator framework, conformity responsibilities and applicable substance requirements into focus. Article 5 includes restrictions concerning substances in packaging, with specific PFAS limits for food-contact packaging from August 2026. Obtain material specifications and appropriate evidence from suppliers instead of treating a generic “eco-friendly” statement as a compliance record. The precise restrictions and test approach require a material-specific assessment.

Article 10 separates packaging minimisation from its prohibition of specified features intended only to increase perceived volume. The main obligation to reduce weight and volume to the minimum necessary, assessed against the performance criteria in Annex IV, applies by 2030-01-01. Keep evidence of product protection, logistics needs, hygiene and functionality. Arbitrarily shrinking packaging without checking damage or safety can replace one problem with another.

Recyclability requirements under Article 6 are phased. Design-for-recycling criteria, performance grades and recycling-at-scale requirements are linked to later dates and supporting acts. An unknown multilayer structure or composite adhesive may become a future problem, but a software warning is not the legal recyclability grade. Ask suppliers for the actual material construction and retain a versioned specification for every packaging component.

The empty-space rule: 50%, not 40%

Article 24 sets a maximum empty-space ratio of 50% for grouped, transport and e-commerce packaging. The operative date is 1 January 2030 or 3 years after the relevant implementing acts enter into force, whichever is later. It is not an immediate 40% limit on every product box. Sales packaging has its own minimisation requirements, and Article 24 contains specific treatment and exceptions.

The calculation compares the total volume of the relevant packaging with the volume of the sales packaging or products it contains, as specified by the provision and implementing methodology. Space filled with cushioning materials—including paper cuttings, air cushions, foam and similar filling materials—is treated as empty space for this purpose. Adding more void fill is not a way to make a largely empty shipping box compliant.

Prepare measurements now by SKU and shipping configuration: outer dimensions, contents, sales-packaging dimensions, fill material and evidence of protection needs. Separate a single-item parcel from a multi-item order. A packaging supplier can help test alternative sizes and structures, but the seller should retain the rationale and identify which economic operator bears the Article 24 duty.

Packaging EPR and authorised representatives

Article 44 provides national producer registers; PPWR does not create a single EU register replacing LUCID and every other national register in 2029. Registration and reporting remain tied to Member States, with harmonisation of information requirements. Keep country registrations, scheme memberships, declared weights and reporting deadlines separate from product-level conformity documentation.

Article 45(3) requires producers within Article 3(1)(15)(c) and (d) to appoint an EPR authorised representative by written mandate in each Member State where they first make packaging or packaged products available other than their establishment State. This is not merely one representative anywhere in the EU. Determine the producer category and destination markets before applying the requirement.

Proposed changes to representation obligations have been under legislative consideration. A proposal is not a suspension of enacted law; the EUR-Lex procedure checked for this guide remained ongoing. Check the current consolidated law and the destination authority before a new appointment or renewal. Registration, reporting and financing obligations must not be treated as optional while a proposal is discussed.

The PPWR EPR representative is different from a product-compliance authorised representative under Article 21 and from the GPSR responsible operator. Do not automatically assign all packaging technical-documentation duties to an EPR representative. The written mandate should identify the actual EPR tasks, countries, products, reporting arrangements and communication responsibilities, and the provider should confirm its acceptance.

France can also have country-specific EPR requirements. Read our French EPR representative guide rather than assuming the general EU packaging framework answers every French waste-stream question. Regonance is software, not a mandataire or an appointed EPR representative.

Labelling and digital information

Article 12 does not impose a universal packaging QR code from 2027. Harmonised material-composition labels apply from 12 August 2028 or 24 months after the relevant implementing acts enter into force, whichever is later. Reusable-packaging information has its own rules and timing; digital means are required or permitted for specific information, not interchangeable with every physical label.

Avoid ordering several years of pre-printed packaging based on a draft icon or an assumed mandatory QR format. Track the adopted implementing measures, reserve space in artwork and keep the label specification version with the packaging record. Existing national sorting information may still need attention during the transition; a future harmonised label is not permission to remove current country-specific obligations prematurely.

Recycled-content and reuse requirements

Article 7 sets minimum post-consumer recycled content in specified plastic packaging categories from 2030 or three years after the relevant implementing act enters into force, whichever is later. The first-tier targets are 30% for contact-sensitive packaging predominantly made of PET, 10% for other contact-sensitive plastic packaging, 30% for single-use plastic beverage bottles and 35% for other plastic packaging. Exemptions and calculation rules matter; do not apply one percentage to every plastic component.

The 2040 targets rise respectively to 50%, 25%, 65% and 65%. Supplier statements should distinguish post-consumer recycled material from other recycled inputs and explain the method and evidence. Record the category, material weight and calculation basis so procurement can compare technically suitable options without treating a marketing claim as verified target compliance.

Article 29 contains reuse obligations for specified transport and related packaging, with different situations, targets and exceptions. Article 33’s consumer reuse provisions concern relevant beverage and takeaway-food distribution, not a blanket reusable-shipping option at every e-commerce checkout. Analyse the packaging format and supply arrangement; do not add a checkout promise that your logistics operation cannot actually fulfil.

Common mistakes

  • Treating August 2026 as the effective date of every requirement.
  • Repeating a 40% empty-space rule or counting all void fill as product volume.
  • Expecting a single EU registration to replace national packaging EPR registers.
  • Using one GPSR representative as proof that every national EPR appointment is covered.
  • Assuming marketplace fulfilment removes producer duties.
  • Applying food-service reuse rules to every online retail checkout.

Frequently asked questions

Does a GPSR Responsible Person also cover PPWR packaging EPR?+

Not automatically. Product-safety responsibility, product-compliance representation and packaging EPR representation have different tasks. Article 45(3) requires covered producers to arrange the relevant destination-country EPR mandates.

Does PPWR apply to B2B packaging?+

Yes. Transport, grouped and other business packaging are within scope, although requirements vary by packaging type, operator role and the specific exemptions in each provision.

What counts as empty space under PPWR?+

Article 24 defines the ratio for the relevant packaging and treats space filled with cushioning material as empty space. The maximum is 50%, from 1 January 2030 or three years after the relevant implementing acts enter into force, whichever is later.

Will one EU packaging registry replace LUCID in 2029?+

No such replacement is established by the enacted PPWR. Article 44 retains national producer registers and harmonises registration information; destination-country EPR duties still require separate attention.

Does every online seller need a reusable shipping option at checkout?+

PPWR does not impose that blanket rule. Article 29 covers specified packaging reuse duties; Article 33’s consumer reuse options concern the relevant beverage and takeaway-food distribution situations.
